The ESOS Framework & Your Obligations

Under the Education Services for Overseas Students (ESOS) Act 2000, student visa holders in Australia must:

  • Maintain enrolment in a registered (CRICOS) course at all times
  • Obtain a new Confirmation of Enrolment (CoE) before switching providers
  • Adhere to the transfer restriction policy that applies in their first six months of study (unless specific exceptions apply)
  • Notify the Department of Home Affairs of course or institution changes through updated CoE details

When Is a Transfer Allowed in the First 6 Months?

Within the first 6 months of your principal course, transfers to another institution are generally restricted. However, exceptions apply when:

  • Your original institution has ceased to deliver your course
  • Your original institution has agreed to release you in writing
  • Continuing at the original institution would cause you genuine hardship
  • Your original institution has materially breached a written agreement with you

After 6 months, you are generally free to transfer to another registered provider — provided you obtain a new CoE and update your visa accordingly.
